Please read this agreement carefully. It's a contract that governs your use of Techie LLC Service (the "service"). By using or accessing the service, you confirm that you agree to these terms. If you don't agree, don't use the service. Thanks.
Please note that we don't provide additional warranties for the service. This contract also limits our liability to you.
PAY FOR SUPPORT
(a) Services: TECHIE LLC will attempt problem diagnosis and a solution at location of computer for an applicable fee. In certain cases, however, problem diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.
(b) Payments: Payments for parts and services must be made by cash, or guaranteed check, made payable to Techie LLC, prior or upon delivery of service.
(c) No Fix - No Fee explained
If I am unable to diagnose the problem and/or provide a solution, then you will not be charged.
If I am unable to complete the job because:
You are unwilling for me to proceed further, pending no work already performed
You do not have the necessary software or product keys, pending no other work already done.
Hardware needs to be replaced/added/repaired
The equipment is deemed to be beyond repair
you will be charged.
No Fix - No Fee does not apply to Data recovery and Virus/Spy ware removal
(d) User Responsibility: You understand and agree that prior to contacting or allowing
TECHIE LLC to perform diagnostic repair on your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or drives. You acknowledge and agree that TECHIE LLC shall not be responsible under any circumstance for any loss or corruption of data and/or software.
Loss of Data
Whilst I will endeavor to preserve and/or recover your data, I cannot guarantee that data will not be lost or corrupted. There is always a danger that data will be lost when repairing, configuring or otherwise servicing hardware or software. Please ensure that all important/valuable data is backed up. You will be asked to sign a declaration that you understand and accept such risks.
(a) Scheduling: Standard service hours are Monday-Friday, 5 PM – 10 PM, Saturday 10 AM – 5 PM. Additional charges may apply for rapid response services or service outside of standard installation hours.
(b) Service Jurisdiction: TECHIE LLC sets the Service Jurisdiction for each location of repair. If a location lies beyond TECHIE LLC's standard Service Jurisdiction, additional trip charges may apply. To determine if your location is within the TECHIE LLC standard Service Jurisdiction please call (210) 330-2742.
(c) Additional Hardware or Software Install/Service: This service is only available to customers who have already purchased one on-site service and are purchasing this as a second service. Approved services must be one of the following: software installation, software service, memory installation, sound/video card installation, network card installation, modem installation,
CD/DVD-RW installation, or CD/DVD-ROM installation.
(d) An adult must be present at residences or business: for on-site services, a person of at least 18 years of age must be present during the entire time period services are provided. if TECHIE LLC arrives at the scheduled service time and no adult is present, services may be denied and a $25 cancellation charge will be assessed.
(e) Backup your software and data: it is your responsibility to back up all software and data that is stored on your computer's hard disk drive(s) and/or on any other storage devices you may have prior to the arrival of TECHIE LLC to your home or business. TECHIE LLC shall not be responsible at any time for any loss, alteration or corruption of any
software, data or files.
(f) Minimum System Requirements
· Minimum Requirements (Networking, upgrades, installations and typical repairs)
· All Passwords must be provided, for OS, Routers, Modems, Web Acct’s. If applicable
· Minimum of 20% hard drive space available.
· All data, software and information including email and contacts are back-up.
· Need all product keys for all software including web accounts.
· OS product key must be available at time of service.
· For all broadband installations, the broadband services must be installed and operational prior to the time of service, including connections to any broadband modem.
· All Networking ( computer(s) and/or peripherals needs to be in good working order and free of any viruses or spy and adware)
· MS Win 98 SE is minimum for Networking (wired or wireless)
(g) Access: TECHIE LLC must receive full access to the computer(s) and/or peripheral(s) to be serviced, access to your residence, your consent and cooperation to enter your
residence or business, and a safe working environment, working space and electrical power. If TECHIE LLC arrives at the scheduled service time and determines that he does
not reasonably have the access, cooperation, or safe working area described in the previous sentence, then services may be denied and a $25 cancellation charge will be assessed.
TERMS APPLICABLE TO PAY FOR SUPPORT AND IN-HOME/OFFICE SERVICES:
limitations to service: TECHIE LLC reserves the right to refrain from providing any or all services ordered and instead refund (If already pre-paid) the customer's payment, wholly or in part, on the basis that the minimum system requirements are not met or the technical needs (including wiring or overcoming physical or technical barriers) or other requirements of the customer are unusual or extensive and beyond the scope of this service agreement as reasonably determined by TECHIE LLC.
If TECHIE LLC’s ability to render services is impaired by you or circumstances beyond the control of TECHIE LLC, TECHIE LLC may choose not to provide
services. limitation of remedy: under no circumstances shall TECHIE LLC be liable to you or any other person for any damages, including without limitation, any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of, or related to, the services provided by TECHIE LLC or out of the installation, reinstallation, use of, or inability to use your computer equipment, hardware, peripherals, or the network resulting from the services provided hereunder, release of liability: by signing the approval form, you affirmatively release and hold harmless TECHIE LLC from and against any loss, liability, or damage that you or the owner or lessee may suffer, including but not limited to any loss of any data and the non-functioning of any component or element of your computer equipment or peripherals resulting from TECHIE LLC regardless of the warranties, disclaimers and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you.
1.1. These Terms and Conditions together with any document expressly referred to in them, contain the entire agreement between Us relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between Us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these Terms and Conditions.
1.2. By You using our service, you are agreeing to these Terms and Conditions You confirm that You have not relied on any representation save insofar as the same has expressly in these Terms and Conditions been made a representation and You agree that You shall have no remedy in respect of any misrepresentation which has not become a term of this
1.3. All parts of this contract apply to the maximum extent permitted by relevant law. If a court holds that we cannot enforce a part of this contract as written, you and we will replace those terms with similar terms to the extent enforceable under the relevant law, but the rest of this contract won't change. This is the entire contract between you and us regarding the service. It supersedes any prior contract or oral or written statements regarding your use of the service.
Techie LLC reserves the right to modify or add to these Terms and Conditions, prices, website information and services at any time without prior
notification. CHANGES, CANCELLATIONS AND REFUNDS To change your order you must contact TECHIE LLC at (210) 330-2742
You may cancel your order if you give TECHIE LLC at least 2 hours notice prior to the scheduled performance of services. Cancellations must be completed by calling (210) 330-
2742. If prepaid, the payment amount, will be fully refunded in the manner the purchase was paid.
